Introduction

Welcome to Baiuv.

Baiuv is an AI image creation tool for consumer users. Users may enter prompts, upload reference images, generate AI images, manage projects, and view generation history. Baiuv is currently in a development / pre-production stage. Certain features, interfaces, credits, paid plans, account settings, account deletion flows, administrator review, and content management tools may still be tested, adjusted, or released in phases.

This document is a product terms draft and does not constitute formal legal advice. Baiuv’s formal operating entity, governing law, jurisdiction, and certain commercial policies may be further updated before public launch.

By using Baiuv, you confirm that you have read, understood, and agreed to these Terms. If you do not agree to these Terms, do not use Baiuv.

1. The Service

Baiuv provides AI image creation features, which may include:

  1. entering text prompts to generate AI images;
  2. uploading reference images to guide or support image creation;
  3. selecting or adjusting generation parameters;
  4. creating, managing, and saving projects;
  5. viewing generation history;
  6. managing account settings;
  7. using free credits, promotional credits, paid credits, plans, or other digital services;
  8. requesting account deletion or deletion of related information;
  9. going through necessary safety review, administrator review, and content management processes.

Baiuv may call third-party AI image generation services on the backend. Baiuv may also use third-party infrastructure, storage, CDN, security, CAPTCHA or similar verification, email, and payment services. To complete your requests, Baiuv may transmit your prompts, reference images, generation parameters, and necessary technical information to relevant third-party service providers.

2. Eligibility

You must be at least 18 years old to use Baiuv.

If you are under 18, you may not register for, access, or use Baiuv. Baiuv is not intended for minors, and users must not use Baiuv to generate, upload, distribute, or request any sexual content involving minors or any other illegal or prohibited content.

3. Account Registration and Security

Baiuv’s account system uses email and password authentication. When registration opens in the future, Baiuv may use CAPTCHA or similar verification tools to prevent abuse, bot registration, and malicious attacks.

Public usernames may be assigned by the system. Unless Baiuv separately provides a username change feature, you should not assume that you can choose, reserve, or change your public username.

You are responsible for keeping your account, password, and login credentials secure. You are also responsible for activities that occur through your account. If you believe your account has been compromised or accessed without authorization, contact Baiuv at [email protected].

Baiuv may require verification, adjust account status, limit certain features, or reject suspicious registration, login, or usage activities when reasonably necessary for security, compliance, risk control, or product operations.

4. User Content

When using Baiuv, you may submit, upload, generate, save, or manage:

  1. text prompts;
  2. reference images;
  3. generation parameters;
  4. project content;
  5. generated outputs;
  6. other content or information related to generation history, account settings, or support communications.

Together, these are referred to as “User Content.”

You are responsible for ensuring that your User Content does not violate applicable laws, infringe any copyright, trademark, publicity right, privacy right, reputation right, trade secret, or other rights, or violate these Terms or Baiuv’s platform rules.

You must not upload, enter, or use materials that you do not have the right to use. You must not use Baiuv to create or distribute infringing, illegal, fraudulent, misleading, harassing, hateful, sexual, violent, terrorist, privacy-invasive, or otherwise inappropriate content.

5. Rights in User Content and Outputs

You retain any rights you lawfully hold in your uploaded content, prompts, and generated outputs. Baiuv does not claim ownership of your User Content or generated outputs.

To provide, maintain, improve, and protect Baiuv, you grant Baiuv a limited, necessary, non-exclusive license to process, store, copy, transmit, display, generate, review, and manage relevant content to the extent needed to operate the service.

This license is used for purposes such as:

  1. receiving and processing your generation requests;
  2. calling third-party AI image generation services;
  3. saving projects and generation history;
  4. displaying generated outputs and related records;
  5. troubleshooting, fixing errors, and improving performance;
  6. conducting safety review, administrator review, and content management;
  7. preventing abuse, fraud, attacks, and other violations;
  8. improving product experience, performance, and security in an aggregated or de-identified manner.

By default, Baiuv does not use your uploaded content, prompts, or generated outputs to train Baiuv’s own foundation models or third-party foundation models, unless Baiuv separately informs you and obtains express consent where required by applicable law.

6. Use of Generated Outputs and Commercial Use

Baiuv does not guarantee that generated outputs may be used commercially.

Whether an output can be used for commercial purposes depends on multiple factors, including:

  1. your prompts;
  2. your uploaded or referenced materials;
  3. the rules of third-party AI image generation services;
  4. the rights status of third-party materials, people, brands, trademarks, works, or styles;
  5. applicable laws and regulations;
  6. whether the output resembles existing works, likenesses, trademarks, trade dress, or protected content.

You are responsible for evaluating the legality, compliance status, and commercial usability of generated outputs. For important commercial uses, you should conduct an independent rights review before publishing, selling, advertising, printing, licensing, or distributing outputs at scale.

7. Third-Party Services

Baiuv may call third-party AI image generation services on the backend. Baiuv may also use third-party infrastructure, storage, CDN, security, CAPTCHA or similar verification, email, and payment services.

To provide the service, Baiuv may transmit necessary information to third parties, including prompts, reference images, generation parameters, technical information, and request-related data. Such data may also be transferred or processed across borders.

Third-party services may have their own terms, usage restrictions, content policies, data processing rules, and availability arrangements. Baiuv will use reasonable efforts to select and manage third-party services, but Baiuv does not guarantee the continued availability, output quality, processing speed, or unchanged rules of any third-party service.

8. Credits, Plans, Paid Features, and Refunds

Baiuv may offer free credits, promotional credits, paid credits, plans, or other paid features. The applicable credits, plans, prices, validity periods, usage scope, and restrictions will be as shown in Baiuv’s product pages or purchase flow.

Unless required by applicable law or expressly stated by Baiuv, purchased credits, plans, and digital services are generally non-refundable.

The following are generally not refundable:

  1. credits that have already been consumed;
  2. generation tasks that have already started processing;
  3. generation tasks that have already completed processing;
  4. restrictions, suspensions, or terminations caused by a user’s violation of these Terms or platform rules;
  5. outputs that do not meet expectations due to the user’s own inputs, materials, network environment, device environment, or operation.

If a system issue causes abnormal credit deduction, Baiuv may issue a credit return, compensation, or other reasonable resolution based on backend records. Baiuv may determine the specific resolution based on the cause, impact, backend logs, and verifiable records.

9. Prohibited Uses

You must not use Baiuv for:

  1. illegal activities or attempts to evade legal requirements;
  2. infringement of copyright, trademark, publicity rights, privacy rights, reputation rights, trade secrets, or other rights;
  3. generating, uploading, distributing, or requesting sexual content involving minors;
  4. non-consensual sexual content, sexualized content without consent, sexual exploitation, or explicit pornography;
  5. hate, harassment, threats, discrimination, insults, or malicious attacks against individuals or groups;
  6. extreme violence, gore, abuse, terrorism, extremist propaganda, or recruitment;
  7. scams, phishing, malicious deception, false advertising, or deceptive content;
  8. impersonation, false identity, or pretending to represent another person, organization, brand, or public figure;
  9. privacy violations, including unauthorized use of another person’s likeness, personal information, sensitive information, or private scene;
  10. unauthorized use of another person’s likeness, trademark, brand asset, trade dress, or protected material;
  11. misleading deepfakes, especially content that may cause public confusion, reputational harm, election-related deception, financial fraud, or personal risk;
  12. bypassing, breaking, or evading Baiuv’s safety systems, credit limits, risk controls, or content moderation systems;
  13. bulk abuse, automated attacks, malicious scraping, credential stuffing, spam requests, or activities that interfere with service stability;
  14. any other activity that Baiuv reasonably believes may harm users, third parties, platform safety, the public interest, or legal rights.

10. Review, Content Management, and Enforcement

Baiuv may use automated systems, human review, administrator review, or other reasonable methods to review and manage user requests, uploaded content, generated outputs, account activity, and unusual behavior.

For serious violations that cross platform red lines, Baiuv may immediately take one or more of the following actions:

  1. suspend or terminate the account;
  2. delete, block, or restrict relevant content;
  3. refuse to continue providing the service;
  4. restrict credits, plans, or paid features;
  5. preserve necessary evidence;
  6. cooperate with competent authorities, rights holders, or other lawful requesters when necessary.

For general violations, suspected risks, or non-malicious issues, Baiuv may take one or more of the following actions:

  1. issue a reminder or warning;
  2. require the user to modify or delete content;
  3. restrict certain features;
  4. reject a specific generation request;
  5. temporarily limit account or credit usage;
  6. remove relevant content;
  7. place the account under further review.

Baiuv will decide the appropriate action based on the nature of the violation, impact, user history, level of risk, and applicable legal requirements.

11. Data Retention, Account Deletion, and Deletion Requests

User projects, generation history, uploaded content, and generated outputs are retained while the account exists, so that you can continue to view, manage, and use them.

You may request account deletion or deletion of related personal information through the in-product account deletion entry, or by contacting [email protected].

After account deletion or a deletion request is completed, related account content will be removed from active services. However, Baiuv may retain certain records for a period of time where required or reasonably necessary for legal compliance, security, audits, accounting, dispute resolution, backup rotation, or technical limitations.

Baiuv does not currently commit to providing a self-service data export feature. If Baiuv offers data export, migration, or backup download features in the future, Baiuv may separately explain the scope, format, limitations, and processing time.

12. Service Availability and Pre-Production Status

Baiuv is currently in a development / pre-production stage. The service may experience feature changes, model changes, unstable generation quality, credit rule adjustments, paid feature testing, access limitations, maintenance interruptions, data structure changes, or other conditions typical of a pre-launch product.

Baiuv will use reasonable efforts to maintain service stability and security, but Baiuv does not guarantee that the service will always be uninterrupted, error-free, delay-free, or meet your specific needs.

Baiuv may adjust features, interfaces, rules, credits, plans, pricing, review mechanisms, or third-party services based on product development, compliance, security, operations, or commercial considerations.

13. Baiuv Intellectual Property

Except for User Content and rights that users lawfully hold in generated outputs, Baiuv and its related software, interface design, marks, trademarks, service names, technology, documentation, page elements, feature structure, and other platform content are owned by Baiuv or its relevant rights holders.

Without express permission from Baiuv or the relevant rights holder, you may not copy, modify, reverse engineer, sell, rent, sublicense, scrape, mirror, imitate, or otherwise misuse Baiuv’s platform content, technology, or brand assets.

14. Disclaimers

To the maximum extent permitted by applicable law, Baiuv is provided on an “as is” and “as available” basis.

Baiuv does not guarantee that:

  1. generated outputs will be accurate, complete, original, lawful, fit for a particular purpose, or commercially usable;
  2. the service will always be uninterrupted, error-free, vulnerability-free, or risk-free;
  3. third-party AI image generation, storage, CDN, security, CAPTCHA or similar verification, email, payment, or other services will always be available;
  4. content obtained through Baiuv will meet user expectations;
  5. all illegal, infringing, or inappropriate content will be detected or blocked in real time.

You understand and agree that AI-generated content is inherently uncertain. You are responsible for reviewing, evaluating, and assuming the risks of using Baiuv and its generated outputs.

15. Limitation of Liability

To the extent permitted by applicable law, Baiuv and Baiuv Operations Team will not be liable for indirect, incidental, special, punitive, consequential, or loss-of-profit, loss-of-revenue, loss-of-data, or loss-of-goodwill damages arising from:

  1. your use of or inability to use Baiuv;
  2. generated outputs that do not meet expectations;
  3. third-party service failures, delays, rule changes, or unavailability;
  4. disputes caused by user input, uploads, distribution, or use of content;
  5. unauthorized account access, unless caused by Baiuv’s intentional misconduct or gross negligence;
  6. force majeure, cyberattacks, system maintenance, infrastructure failures, or other events beyond reasonable control.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

16. Changes to These Terms

Baiuv may update these Terms based on product development, laws and regulations, third-party service rules, commercial arrangements, or security and compliance needs.

If material changes are made, Baiuv will provide notice in a reasonable manner, such as through in-product notices, page updates, or notifications. Updated Terms will take effect on the stated effective date.

If you continue to use Baiuv after the Terms are updated, you accept the updated Terms.

17. Dispute Resolution

If you and Baiuv have a dispute arising from the service or these Terms, you should first contact Baiuv Operations Team at [email protected], and both sides should try to resolve the matter amicably.

If the dispute cannot be resolved through discussion, it will be handled under applicable law. The specific governing law and jurisdiction rules will be updated after Baiuv’s operating entity is further confirmed.

Pre-launch items to confirm

Before Baiuv’s public launch, the operator, legal, compliance, payment, and technical teams should confirm:

  1. Baiuv’s formal operating entity, registered address, company information, and contracting party;
  2. governing law, dispute resolution method, and jurisdiction;
  3. countries or regions where the service will be available and whether regional restrictions are needed;
  4. free credits, promotional credits, paid credits, plans, validity periods, and deduction rules;
  5. refund exceptions, statutory cooling-off rights, and consumer protection requirements;
  6. specific providers for third-party AI image generation, payment, CAPTCHA or similar verification, email, CDN, storage, and security services;
  7. content moderation standards, platform red lines, appeal process, and violation tiers;
  8. specific retention periods for User Content, generated outputs, project history, and backend logs;
  9. deletion process, backup rotation, and log retention period after account deletion;
  10. whether self-service data export, invoice, receipt, or billing download features will be offered;
  11. whether the commercial-use explanation requires more detailed licensing boundaries or risk disclosures;
  12. whether separate copyright, likeness, trademark, or DMCA / similar complaint pages are needed;
  13. whether target markets require consumer terms, platform rules, AI content labeling, or transparency disclosures.
